1. General information

Under the Act respecting the protection of personal information in the private sector, personal and confidential information is information that identifies a natural person. Confidential information therefore means any sensitive information whose access and use is restricted to persons or entities designated for this purpose and whose dissemination would cause prejudice to the entity and its partners or to individuals.

La Transformerie recognises that it will have access to personal, confidential, strategic, commercial, technical or legal information relating to the operations of clients, partners, organisations, prospects, employees, candidates, volunteers and donors (hereinafter referred to as stakeholders), particularly with regard to its strategies, business opportunities, intellectual property, outsourcing agreements and other information of this nature.

La Transformerie is therefore committed to protecting the confidentiality and security of its stakeholders’ personal information. The purpose of this policy on the protection of personal information is to help understand the practices regarding the collection, use and retention of personal information.

2. Applicable laws

La Transformerie is subject to the provisions relating to the protection of personal information in the Act respecting the protection of personal information in the private sector (RLRQ, c. P-39.1) when this type of information is held as part of its functions and activities.

3. Collection of information

Personal information is collected in a number of ways, including business model forms, networking events, database transfers, and by communicating with us in person, by telephone, by instant messaging, by mail or by email. La Transformerie only collects personal information that is necessary for the conduct of its business and for the fulfilment of the identified purposes.

Depending on the circumstances, personal information may include the identification of clients, partners, organizations, prospects, employees, volunteers, candidates, donors, payment management information, strategic or contractual information about an entity, etc.

4. Use of information

Measures have been put in place to ensure that only authorised persons have access to personal information and are authorised to process data. A confidentiality undertaking must therefore be signed beforehand by all employees, agents and/or subcontractors of La Transformerie who have access to computer systems and confidential data. In this way, no data will be transferred to a third party without the written approval of the parties involved. La Transformerie recognises that Confidential Information remains the exclusive property of the stakeholders and that any unauthorised disclosure of this Confidential Information may cause it significant damage. In order to protect the interests of the stakeholders, La Transformerie will use the Confidential Information disclosed solely for the purposes for which it was disclosed. In addition, all stakeholder data remains confidential, unless it has been published in the media or by the stakeholders.

A document is considered non-confidential:

● If it contains no personal information and has no strategic value for the entity;

● If at the time of its disclosure, was in the public domain;

● If it becomes available, after the transfer of information between the stakeholders and La Transformerie, generally to the public, by publication or otherwise, and this disclosure is not the result of any fault on the part of La Transformerie;

● If it is disclosed to La Transformerie by a third party;

● If it is government information.

The information collected is used for the following purposes:

● To mobilise volunteers in various tasks;

● To offer products and ensure sales;

● To analyse and respond to requests from customers and prospects;

● To manage donations;

● Record confidential data in the database;

● Save changes made to the database;

● Process data;

● Provide a specialist service in the area of food waste reduction.

5. Conservation of information

La Transformerie retains stakeholders’ personal information for as long as necessary to provide its services, or as required by applicable laws, regulations or government orders. Personal information may be retained for different periods depending on the nature of the information and the purpose for which it is held. By using the Transformerie’s services, stakeholders give their consent to the transfer of personal information to its database. La Transformerie never sells personal data to third parties and written authorisation is required before transferring confidential stakeholder information to a third party.

La Transformerie has put in place appropriate physical, technological or administrative safeguards to protect the confidentiality and security of personal information against accidental or unlawful destruction, accidental loss, alteration, unauthorized disclosure or access, misuse or other unlawful form of processing of personal information in its possession.

However, no method of Internet transmission or means of electronic storage is 100% secure. If you have reason to believe that the confidentiality of personal and/or confidential information has been compromised, please contact us.

In addition, La Transformerie agrees to take the necessary steps without delay to limit the damage likely to result from a breach, to conduct an investigation to identify any vulnerability and to take the necessary corrective measures to avoid any recurrence of such an incident.

6. Update

The contents of this policy may be changed without notice to reflect changes in our practices, technology, legal requirements and other factors. Changes to this policy will take effect immediately. We therefore encourage stakeholders to stay informed about how La Transformerie handles personal information.
